
XpertHR’s The Top 10 HR Compliance Challenges for 2019 Report analysed responses from more than 800 HR professionals in the US to discover the most challenging human resources compliance and employment law issues in 2019.
Main findings from this study include:
- Making preparation for the health care future and the ACA was considered as very or extremely challenging for 39% of HR professionals. 34% of them found it very or extremely difficult to understand the federal marijuana policy, especially with the rapid change of state laws. 31% of HR professionals are struggling with recruiting employees on visas. 29% of them didn’t find it easy to get ready for the proposed overtime regulations rules and 28% of them claimed it was very or extremely challenging to understand the impact of the Supreme Court conservative makeup on employment law.
- Paid sick leave laws were considered to be very or extremely challenging by 38% of respondents, while 36% of them was struggling with paid family/parental leave. Medical and recreational marijuana laws were also a big concern for 32% of respondents. Other issues that were rated as very or extremely challenging includes investigating harassment complaints and equal pay and wage disclosure laws.
- Finding high-quality job candidates was rated as very or extremely challenging for 64% of HR professionals. More than half of them had difficulties making sure employees and managers have the required skills for present or future responsibilities. 50% of them also admitted that succession planning and their efforts to increase employee engagement and satisfaction were extremely challenging as well. Nearly half of the respondents agreed that employee retention, performance management and employee development were also areas of concern. Other challenging matters include employee mergers and acquisition, layoffs management and downsize need.
- Most HR professionals found it very or extremely difficult to track and comply with leave laws across states and localities. Nearly half of them also struggled to manage leaves and make decisions on the most suitable federal, state and local leave laws required for specific employee circumstances.
- 40% of respondents had difficulties deciding whether organizations should provide uniform leave benefits or different benefits based on location. More than one-third of them regarded making decisions on employee leave benefits strategy as very or extremely challenging.
